1. Acceptance of Terms

These Terms of Service (“Terms”) govern your use of tax305.org and any services provided through this website. tax305.org is operated by Dynamic 305 LLC.

By accessing this website, submitting an intake form, uploading documents, or engaging our services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Scope of Services

We provide remote tax preparation and tax return filing services only. Services may include preparation of federal and applicable state tax returns and electronic filing when eligible.

We do not provide legal representation before the Internal Revenue Service (IRS), do not accept Power of Attorney (POA), and do not act as your authorized representative.

Limited assistance may be provided for basic IRS correspondence strictly related to returns we prepared. This does not constitute representation.

3. No Guarantees

We make no guarantees regarding refund amounts, eligibility for credits, acceptance by the IRS, processing times, or tax outcomes.

All tax results depend on the information provided by the client and decisions made by tax authorities.

4. Fees, Payments, and No Refund Policy

Tax preparation fees are based on the complexity of the return. Minimum fees apply.

All preparation fees are non-refundable once work has begun.

Fees are owed regardless of:

  • The amount of any refund
  • Whether a refund is delayed, reduced, or offset
  • Whether the client later withdraws or abandons the process
  • Whether the return is ultimately accepted or rejected by the IRS

Payment is due before electronic filing. Returns will not be e-filed until payment obligations are satisfied.

5. Bank Products

Optional bank products (such as refund-based fee payment or refund transfers) may be offered through third-party financial institutions.

  • Bank products are optional and not required
  • Approval is determined solely by the third-party provider
  • We do not control bank eligibility decisions
  • Fees remain owed even if a bank product is denied, delayed, or fails

6. Client Responsibilities

You agree to:

  • Provide accurate, complete, and truthful information
  • Maintain and supply required supporting documentation
  • Review your tax return before authorization and filing
  • Authorize electronic signatures where applicable

You acknowledge that penalties, interest, or adjustments resulting from inaccurate or incomplete information you provide are your responsibility.

7. Errors and Corrections

If an error results from information you provided, you are responsible for any consequences.

If an error results directly from our preparation, our obligation is limited to correcting the return. We do not assume liability for penalties, interest, lost refunds, or consequential damages.

8. Communications, SMS, and Telephony

By submitting your contact information, you consent to receive service-related communications via email, SMS, and telephone.

  • Messages are limited to service notifications and compliance updates
  • Message frequency varies based on service activity
  • Standard messaging rates may apply
  • You may opt out of SMS by replying STOP

Telephone calls may be recorded for quality assurance, training, or compliance purposes where legally permitted.

9. Data Handling and Privacy

Your information is handled in accordance with our Privacy Policy and applicable IRS regulations, including Internal Revenue Code §7216 and IRS Publication 4557.

10. Refusal or Termination of Service

We reserve the right to refuse or terminate services at our discretion, including but not limited to cases involving:

  • Suspected fraud or misrepresentation
  • Failure to provide required documentation
  • Abusive or inappropriate behavior
  • Non-compliance with these Terms

Fees earned prior to termination remain due and payable.

11. Limitation of Liability

To the fullest extent permitted by law:

  • We disclaim liability for indirect, incidental, or consequential damages
  • Our total liability is limited to the fees paid for the services provided
  • We do not guarantee tax outcomes or government decisions

12. Governing Law and Venue

These Terms are governed by the laws of the State of Florida.

Any dispute shall be brought exclusively in Miami-Dade County, Florida.

13. Dispute Resolution

In the event of a dispute, the parties agree to attempt resolution through good-faith mediation before initiating court proceedings.

14. Eligibility

Services are available only to individuals who are at least 18 years of age and are U.S. taxpayers. Services are offered remotely nationwide.

15. Modifications

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated effective date.
